Davis Law Group Car Accident and Personal Injury Lawyers has filed a civil lawsuit on behalf of a 68-year-old woman who was involved in a Tumwater-area accident caused by a semi truck.
Kathleen Heaton enjoys spending time with her family and friends. She works as a driving instructor for Defensive Driving School. Prior to the collision, she was in great health, pain-free, and able to perform professional and personal work without any discomfort or pain.
On March 20, 2018, at approximately 11:04 a.m., Kathleen Heaton was traveling southbound on I-5 in lane two of three near Tumwater. Randall Lebo was traveling northbound I-5 when the semi-truck her was driving lost a wheel from the right front trailer axle. The wheel traveled across all lanes of northbound I-5, crossed the center jersey barrier and entered the sound bound lanes striking Kathleen’s vehicle. State Patrol responded to the scene and upon investigation cited your insured for “Defective Equipment (collision causing)”.
Substantial damage was done to the side of the vehicle, clearly documenting the force involved in the collision.
Upon impact, Kathleen’s body was violently jolted and tossed around the inside of the vehicle hitting against the interior components. She slammed her head into the side window, which left her with glass abrasions.
As a direct result of your insured’s’ negligence, Kathleen sustained injuries to her left hand, shoulder and leg, damaged her teeth, low back and associated body structures.
There is no dispute concerning liability in this matter. Herche Transfer Company was negligent when they equipped their semi-truck with defective equipment.
Kathleen has experienced, and continues to experience, a significant loss of enjoyment of life. This collision disrupted and changed Kathleen’s life. She was fairly healthy before the collision and since then has not been as active as she was before. She has been unable to walk long distance and resorted to a scooter to get around. She was unable to kneel, squat or bend at the waist. Her daily life activities, such as dressing herself, washing and folding laundry, cooking, and bathing were severely affected by this impact.
