Breach of Contract Lawsuit Filed Against Progressive After Crash

Pierce County Superior Court (12/12/2016) - Insurance bad faith attorney Chris Davis, founder of Davis Law Group, P.S., has filed a civil lawsuit (16-2-13516-7) in Pierce County Superior Court against Progressive Insurance on behalf of a Graham man for breach of contract damages in relationship to a car accident claim.  

The rear-end collision that took place on 12/19/2013.  The injury victim’s (plaintiff) vehicle was stopped while waiting to make a turn on Meridian in Puyallup. Suddenly and without warning, the victim’s vehicle was struck from behind by the vehicle driven by defendant.  Apparently the defended was exiting a parking lot at a high rate of speed.  

The defendant driver breached his duty of care and his duty to act reasonably by, among other things, failing to exercise ordinary care and causing a collision with plaintiff’s vehicle.

The victim, an employee of Bates Technical College, sustained bodily injury and other damages as a result of the collision. He suffered physical injuries, emotional trauma, medical expenses, lost earnings, and other damages.

According to the complaint for damages, the at-fault driver was underinsured at the time of the collision.  The victim had an automobile insurance policy through Progressive Insurance which included underinsured motorist coverage.  The plaintiff is entitled to recover uninsured/underinsured motorist benefits from Progressive in an amount not less than $100,000.00, the policy limit.

The injury victim is entitled to recover automobile insurance policy benefits from Progressive.  The plaintiff purchased automobile insurance including UM/UIM benefits.  Progressive Insurance has materially breached the insurance contract by delaying payment and/or denying Plaintiff’s claims, and/or by refusing to pay any additional benefits to which the plaintiff is entitled to receive.
