In February 2004, DH was driving his Mazda Northbound on Interstate-405 in Bellevue, Washington. DH slowed and stopped for traffic in front of him on the interstate when he was suddenly slammed into from behind by TM, who was distracted at the wheel.
This car crash was fairly significant and caused substantial damage to DH's vehicle.
Washington law provides that the following driver has the duty to avoid a collision with the driver in front. See Washington Pattern Jury Instruction (WPI) 70.04. TM was negligent when he slammed into DH’s vehicle.
DH sustained the following injuries in this accident:
- Cervical strain secondary to MVA
- Sciatica secondary to MVA.
