Featured Case Result: Head-On Collision On Woodinville-Duvall Road
In December 2007, SM was traveling westbound on N.E. Woodinville-Duvall Road going about her daily errands. She was unexpectedly struck head-on by defendant driver SH, who lost control of her vehicle and crossed the center line, striking SM. Following the impact, SM was trapped in her vehicle until fire department personnel came to her rescue. King County Sheriff’s Office responded to the scene and upon investigation cited defendant driver SH for “speed too fast for conditions”.
Washington law provides that the drivers on the road have the duty to exercise "ordinary care" and avoid causing a collision. See RCW 46.61.445 and Washington Pattern Jury Instruction (WPI) 70.01. As a direct result of SH’s negligence, SM sustained injuries to her leg, knee, ankle, and associated body structures.
A summary of our client's injuries and subsequent medical treatment are outlined below:
- Ankle fracture (left) with resultant pain, discomfort, swelling, bruising, decreased range of motion and limited mobility
- Foot injury and fracture (left) with resultant pain, discomfort, swelling, bruising, decreased range of motion and limited mobility
- Leg fibula fracture (right) with resultant pain, discomfort, swelling, bruising, and limited mobility
- Sleep disturbances/fatigue
At the time of the incident, SM was a 71 year old woman who enjoyed spending time with her family and friends. Hobbies included yard work, walking her dogs, garage sales, shopping, traveling to visit family, reading, music, movies, and outdoor activities.
SM experienced, and continues to experience, a significant loss of enjoyment of life. She was fairly healthy before the collision and since then has not been as active as she was before. She was forced to perform daily exercises at home just to manage her symptoms and avoid flare ups. Her return to recreational activities had been slow and guarded for fear of re-injury.
To help her negotiate a settlement with Progressive Insurance, SM enlisted the services of leading car accident attorney Chris Davis. Mr. Davis, the founder and principal attorney of Seattle-based Davis Law Group, P.S., has been frequently consulted by many leading news agencies for his advice on car accident legal procedures, and has had substantial success obtaining fair and reasonable financial compensation for his clients in the past.
Mr. Davis and the legal team at Davis Law Group negotiated with the insurance companies to achieve the best possible result for the victim. We obtained a confidential six-figure settlement on client SM's behalf, which covered all of her medical bills, lost wages, and other damages including pain and suffering..
