On December 6, 2002, at approximately 7:00 p.m., S.A.* was driving his Toyota RAV4 northbound on Interstate 405 near State Route 167. S.A. slowed and stopped for traffic. He was then suddenly slammed from behind by G.R. This car crash was fairly significant and caused substantial damage to S.A.’s vehicle which needed more than $4,700 in repairs. S.A. suffered personal injuries as a result of the collision.
Washington law provides that the following driver has the duty to avoid a collision with the driver in front. See Washington Pattern Jury Instruction (WPI) 70.04.
Due to the accident S.A. suffered the following injuries:
Cervical sprain/strain
Thoracic sprain/strain
Lumbar sprain/strain
Lumbar disc herniation at L4-5 per MRI
Lumbar radiculapathy
Headaches
Left hip pain
Left leg and foot numbness
