Accident Report: Newcastle Car Accident

In November 2003, L.B. was driving her Toyota Corolla Southbound on Interstate 405 near NE 30th Street in the Newcastle area of Washington State. L.B. slowed and stopped for traffic when she was suddenly struck from behind by J.M. This car crash was fairly significant and caused substantial damage to L.B.’s vehicle. Her vehicle was declared a total loss.

L.B. did nothing to contribute to the cause of the crash and could do nothing to avoid the collision. J.M. was negligent when he slammed into L.B.’s vehicle. Washington law provides that the drivers on have the duty to avoid a collision with other drivers. See RCW 46.61.445 and Washington Pattern Jury Instruction (WPI) 70.01.
