Accident Report: Federal Way Rear-end Cell Phone Texting Accident

KC is 35 years-old. She lives with her boyfriend in Redmond, Washington. KC works part time as a sales representative at Petco. In her spare time, she enjoys reading and working out at the gym. In July 2002, KC was driving her 1999 Saturn SL2 on 348th/Highway 18 in Federal Way, Washington. She stopped for the traffic light at the intersection of 348th/Highway 18 and Enchanted Parkway. While lawfully stopped, she was suddenly slammed from behind by CSH.  It is believed that CSH may have been talking or texting on a cell phone at the time of the accident.  

Washington law provides that the following driver has the duty to avoid a collision with the driver in front. See Washington Pattern Jury Instruction (WPI) 70.04. . CSH was negligent when she slammed into the back of KC’s vehicle. KC did nothing to contribute to the cause of the crash and could do nothing to avoid the car accident—she was just sitting still, minding her own business at the time of the accident. KC suffered personal injuries such as neck and back strain as a result of the rear-end collision.

KC tried to work with the insurance claims adjustors at Progressive Insurance Company to get compensation for her chiropractic care and other medical treatment but Progressive disputed the facts of the accident and KC’s injuries.
