On August 1, 2016, Joel M. Kyle (plaintiff) and Rafael Gonzalez (defendant) were operating automobiles on State Route 536 near North Barker Street in Snohomish County, Washington. Kyle was lawfully operating his employer’s vehicle, acting in the course of his employment with the knowledge and consent of the owner, Pioneer Production & Processing, LLC. Pioneer Production & Processing, LLC does business as Pioneer Nuggets, Washington State licensed manufacturer of marijuana / cannabis products.
Rafael Gonzalez’s vehicle was following behind Kyles’s vehicle. Suddenly and without warning, Kyle was struck from behind by the vehicle driven by Gonzalez. The impact pushed Kyle vehicle into the rear of another vehicle.
Kyle sustained bodily injuries and other damages as a result of the collisions.
Rafael Gonzalez was solely at fault for the subject collision.
At the time of the collision, Rafael Gonzalez carried an automobile insurance liability policy. Gonzalez’s insurance company paid a confidential settlement. However, Kyle’s damages exceed the amount of Rafael Gonzalez’s auto insurance coverage.
Pioneer Production & Processing, LLC uninsured/underinsured coverage was required to cover his medical bills. After initially disagreeing on a fair and just amount, Continental Divide Insurance Company agreed to pay $333,500.
