Our client was a 22-year-old passenger in the vehicle of an intoxicated driver who lost control of the vehicle and crashed on State Route 599 near Tukwila in 2011.
Investigation into the collision determined that our client and the driver had visited a casino in Tukwila earlier in the evening and were headed home when the crash occurred. Washington State Patrol Troopers identified that the driver was traveling at speeds of up to 100 mph and lost control of the vehicle, causing it to roll several times before finally coming to a rest.
As a result of the vehicle rolling multiple times, our client was ejected from the car and he was pronounced dead at the scene of the collision. Witnesses said his body was found approximately 80 feet away from where the vehicle came to rest.
The driver only suffered minor injuries in the crash, while another one of his passengers was airlifted to Harborview Medical Center in Seattle to receive treatment for serious injuries he suffered as a result of the collision.
Truth Revealed in Pursuit of Wrongful Death Claim
The family of the man who was tragically killed in the crash eventually hired Davis Law Group, P.S. to pursue a wrongful death claim and recover the damages they had suffered as a result of this crash.
It was later determined that the at-fault driver was 20 years old at the time, but had consumed a significant amount of alcohol while visiting the casino earlier in the evening. After further investigation, our attorneys were able to prove that the casino had failed to check the driver’s identification to make sure he was old enough to be on the premises and consuming alcohol served by casino staff.
Davis Law Group successfully argued that the casino was liable for the drunk driving collision, and therefore also liable for our client’s damages, because they provided an underage person with intoxicating liquor, a violation of Washington state law. In total, we recovered a $600,000 settlement for the estate of the deceased and his family.
