The lawsuit alleges that the company did not perform a background check on its truck driver, with claims that the driver was inexperienced.
The fatal accident occurred on Dec. 22, 2010 as the victim was traveling north on a major highway in Texas. The tractor-trailer, leased to Acme, was traveling in the same direction.
The tractor-trailer was preparing to make a right turn, but instead steered left, occupying all northbound lanes, the lawsuit states. The vehicle driven by the victim was traveling behind the tractor-trailer, attempting to avoid the large vehicle but was unable to avoid hitting it.
The truck company is accused of negligence for failing to adequately perform a background check, failing to properly evaluate the driver’s capabilities.
The lawsuit seeks wrongful death damages, loss of earnings, loss of earning capacity, pain and suffering, loss of bodily function, mental anguish, mental trauma, medical expenses, survival damages, interest and court costs.
