Wrongful Death Claim Filed against Washington DSHS in Powell Case

The Washington State Department of Social and Health Services (DSHS) is the target of a wrongful death claim in relation to the deaths of Charlie and Braden Powell, who were killed in a house explosion allegedly caused by their father, Josh Powell in February of this year.

According to reports from the Associated Press, a $20 million wrongful death claim was filed against Washington State on Tuesday on behalf of Susan Powell via a guardian ad litem who will represent her. Powell went missing in 2009 and is believed to be deceased, though authorities have never found any evidence to support that belief.

The wrongful death lawsuit alleges that the state’s DSHS office was negligent in failing to monitor the conditions of the boys’ relationship with their father and act in the children’s best interest. The suit also claims that the boys suffered abuse, neglect, mistreatment, and ultimately death as a result of the department’s care.
