Rights of Pedestrians Accident Victims
The recovery for something as traumatic as a car accident, especially when you are a pedestrian is tolling enough on the victim. The concern surrounding how medical bills will get paid or how they’ll afford missing work to recover should not lie on their shoulders.
In a situation like this, so long as there is plenty of insurance, a claim can be made against the driver’s policy. Depending on the specific terms of the policy, the claim may request funds to cover medical bills, lost wages and any other damages resulting from the accident.
An important note in a case like the one presented here is that despite the driver having been arrested, any pending or active criminal charges will not interfere with the ability to pursue a claim. Some people might think it was best to wait for any criminal charges to settle, but that it not the case. It is always in the best interest of an accident victim or their family to consult with an experienced car accident attorney as soon as possible. The right lawyer will be able to provide guidance and breakdown your rights to help you determine the best step forward for you and your family.
