Your Legal Rights as a Pedestrian
If you are able to prove the motorist(s) was responsible — or even just partially responsible — for your injury, you can seek financial compensation through a personal injury claim or lawsuit against the at-fault driver.
Proving the driver was negligent requires showing that they failed to uphold their duty as safe drivers. This may include drunk driving, drugged driving, distracted driving (cell phone use), drowsy driving, failing to yield to pedestrians, etc.
Any of the above factors may have caused your accident, and it’s important that you have someone on your side considering all the possible scenarios.
Each case is different, but generally pedestrians are able to recover compensation for damages, but economic and non-economic. Economic damages include medical bills, lost wages, and any future rehabilitation. Non-economic items are typically pain and suffering and emotional distress.
