Legal Rights and Options For Child Accident Injury Victims
Teens under the age of 18 are considered children in the eyes of the law which has several important implications for any personal injury claims.
The statute of limitations for personal injury claims in Washington State is 3-years, however, for minor victims, they have 3 years from the date of the accident as well as 3-years from their 18th birthday.
For the victims in this accident who may be near 18, they may only have one or two years before they turn 18 and their adult statute of limitations would begin, but this added time even of a couple of months could prove invaluable in the long process of a child personal injury claim.
The passengers in this accident may have a potential claim against the driver of their vehicle depending on the results of the ongoing investigation into the collision.
If it is determined that the driver was negligent in their actions leading up to the collision with the power poll, accident victims even as passengers of the at-fault driver have the right to make a recovery for injuries that were suffered as a result of the driver's violation of their standard of due care.
Even with more time to pursue a child injury claim, you only have one chance to settle a car accident claim and that's why Davis Law Group offers all accident victims free case evaluations with no obligation to sign.
