Unsecured Load of Manure Seriously Hurts Chehalis Teen in Doty

chehalis farm crashAn unsecured load of manure caused a truck crash Monday in Doty, leaving a Chehalis teenager with serious injuries, according to the Lewis County Sheriff’s Office.

The 16-year-old boy was driving a 1981 Kenworth farm vehicle hauling a load of manure around 11 a.m. The incident occurred at the intersection of Mays Bridge Road and Leudinghaus Road in Doty.

While traveling through the intersection, the load became detached and slid forward onto the cab of the truck. The load crushed the cab, trapping the boy before rolling off the cab and onto the road.

The teen had to be extricated by emergency responders. He was left with serious injuries to his legs.

The Lewis County Sheriff’s Office and Washington State Patrol determined the cause of the crash to be an unsecured load.

Who is Responsible for an Unsecured Load Accident?

Having practiced law in Washington state for nearly 25 years, attorney Chris Davis will tell you that it’s not always easy to identify who is responsible for an unsecured load accident. Mr. Davis, founder of Seattle-based Davis Law Group, P.S., understands that each case is unique, and the investigation into the accident is crucial.

An experienced truck accident lawyer like Mr. Davis is capable of nailing down the at-fault parties after an accident. The goal is to figure out the person or parties that were responsible for keeping the truck’s cargo safe.

Potentially liable parties in an unsecured load accident are:

The Truck Driver

When a driver gets behind the wheel of a large commercial vehicle, they are responsible for operating the vehicle and transporting the cargo safely. Truck drivers usually must inspect the load and how it was secured prior to their journey.

There are circumstances that may absolve a truck driver. Nonetheless, the driver is usually at the center of any unsecured load investigation.

The Trucking Company

If a truck driver or any employee was not properly instructed on how to load a vehicle, the trucking company or employer may be liable. Their responsibility is to make sure their drivers understand the rules of the road.

Third Parties

Sometimes an individual or outside company was responsible for loading the cargo. If it was done in a reckless manner, they may be held responsible for damages due to their negligence.
