Wrongful Death Claims After Accidents That Result in Arrest
There are many misconceptions about the difference between criminal and civil law particularly when it involves personal injury claims and criminal convictions or not.
In any discussion of law, there is the need to consider each incident on a case-by-case basis, that being said, a criminal conviction for acts of negligence such as vehicular manslaughter or homicide are good indicators for potential civil liability as well.
Things become more complicated for accident victims though due to the fact that insurance companies exclude intentional or criminal acts from their coverage, meaning that someone being found guilty for intentionally causing a collision could end any chance of a claim with the at fault drivers insurance company and leave the victims with nothing.
Accidents such as this where the circumstances that lead up to the collision are unclear could leave room for an insurance company to try to get out of paying out a claim for their driver, claiming the act may have been intentional, believing their party was not solely responsible for the collision or coming up with any number of other excuses to get out of a claim.
After a serious and complex collision like this victims and their loved ones cannot afford to leave the results up to chance, and should contact an experienced local wrongful death attorney like the team at Davis Law Group when they are ready to discuss their options for the claim, before having any serious discussions with the insurance company.
