Fault in a Head-On Collision in Washington
In general, the driver who is at fault for the accident is liable for damages. Fault depends on negligence — a complicated factor that may depend on several different things.
- Violating a traffic law
- Driving while distracted, drunk or on drugs
- Operating an unsafe vehicle
- Driving without reasonable care
Examples of negligence in a head-on collision may include:
- Improper passing
- Illegal left turn
- Illegal U-turn
- Road rage
- Distracted driving
Even if both drivers have insurance at the time of the accident, the at fault driver may be responsible for paying damages that exceed their own liability insurance limits.
Negligence is the issue most-debated during personal injury cases. Attorneys for the defendant and plaintiff may reach an agreement, or a jury will decide who was at fault, or if both parties were partly responsible.
