Genex Services is a private corporation which is often contracted by other companies to assist with and manage medical care services for injured employees and others who may become injured due to negligence. Its website claims that “Genex is the most experienced managed care provider in the industry.”
Genex was incorporated in 1978, originally under the name General Rehabilitation Services, in Pennsylvania. In 1994, the company changed its name to Genex Services Inc. Since then, the company has helped corporations across the world manage risk and improve their bottom lines.
What Exactly Does Genex Do?
When a company is responsible for a person’s injury – regardless of whether the injured person is an employee of that company or not – the company’s primary goal is to ensure the person recovers from their injuries and that the company’s financial risk or liability for the person’s injuries is as limited as possible. This applies to employees who are injured on the job and are going through the workers’ compensation or disability processes, as well as private citizens who are injured due to a company’s negligence.
At Davis Law Group, we interact with companies like Genex quite often. In situations like trucking accidents where a semi-truck driver has caused a crash, for example, trucking companies will typically hire third-party contractors to investigate the incident and determine the company’s liability for any damage that may have resulted. In many cases, these contractors are quite aggressive and are incentivized by the company which has hired them to minimize financial risk.
Because of this incentive, these contractors often go to extreme lengths to shift as much responsibility or liability as possible onto the injured victim. This allows the trucking company and its insurer(s) to resolve claims for pennies on the dollar and take advantage of people who don’t fully understand their legal rights and may not be in the best position to make life-altering decisions. Our job as personal injury attorneys is to combat the aggressive tactics often utilized by these companies and ensure they are held accountable for their actions.
Amtrak Train Derailment in DuPont, WA
On December 18th, 2017, an Amtrak Cascades train derailed near the town of DuPont, WA. Three people were killed in the tragic incident, and dozens more were injured. Federal and state officials are still investigating the train accident and trying to identify all factors that may have contributed, but the fact of the matter is that somewhere along the line, something went wrong and a large number of people are suffering as a result.
Several victims from the Amtrak train derailment have hired the attorneys at Davis Law Group to represent them in claims against the railroad company. In that time, our legal team has discovered that Genex Services has been hired by Amtrak to manage the medical care process for victims who were involved in the December 18 train crash.
It’s one thing for a third party company to facilitate the claims process and collect information to deliver to the liable parties, but we have found that some of the tactics employed by Genex Services and Amtrak are not in the best interests of the victims, but rather are self-serving to the companies’ goal of minimizing Amtrak’s financial liability and overall risk.
For example, some victims have indicated that representatives from Genex Services entered their hospital rooms uninvited and attempted to get the victims to sign documents related to their medical treatment. Others have reported being offered vouchers, coupons, cash, and other forms of compensation by Genex representatives. It is less likely that these offers of compensation are good-faith efforts by the companies involved, and more likely that they are an attempt to get victims to sign over their legal rights and release the company of its liability.
What To Do If Genex Contacts You
If you are ever injured in an accident that a large company or corporation may be liable for, there is a good chance the company in question will hire a third-party company such as Genex to handle the investigation and claims management processes. And as we have described already, the aggressive tactics employed by these companies often know no bounds, and unannounced same-day hospital visits are not uncommon.
Injured victims who were on board the Amtrak Cascades train that crashed in DuPont should expect to be contacted by Genex representatives in the future, if they haven’t been contacted by the company already. If representatives attempt to get you to sign any documents or offers you any compensation, it is important to keep in mind that in certain cases accepting compensation can be considered a satisfaction of settlement and the company could use that against you if you should choose to pursue legal action in the future.
Our attorneys continue to investigate the circumstances surrounding the Amtrak train accident in DuPont and are preparing to present claims to the company on behalf of our clients.
