A semi-truck without a driver crashed into a home in Edmonds on Monday afternoon, causing thousands of dollars in property damage and traumatizing an innocent family.
According to news reports, the semi-truck belongs to a private company which was working at a home approximately one block away from the scene of the collision. It was unclear what exactly led up to the truck crashing into the home, though police said they were investigating.
A diesel leak caused by the impact was problematic for firefighters and the family was reportedly shaken up by the collision, but there were otherwise no reported injuries. The family has to wait for the insurance company to inspect the home before they’re allowed to re-enter, so they will be staying with nearby family for some time.
Legal Issues In Semi-Truck Crashes
When a commercial vehicle crashes into a home, a thorough investigation must be conducted in order to determine all possible contributing factors and establish liability for the collision. Semi-truck companies have their own team of lawyers and investigators who will try to establish the best possible defense for the company and help them avoid liability.
The fact that this crash occurred while no driver was present in the vehicle also makes the situation more complicated. In a majority of cases, establishing liability for a semi-truck accident involves driver error of some sort.
Human error in general could still be a factor in this case. A number of legal questions should be considered in this collision case, including:
- Who was responsible for parking the vehicle and ensuring that a parking brake had been applied?
- When was the last time the vehicle was serviced, and was it up to date on all required maintenance? Who performed the maintenance work on the vehicle?
- Is there a history of mechanical failures involving this particular vehicle or the company which owns the vehicle?
- Were employees of the company present at the time the truck crashed into the home?
These are just a few of the many legal issues that an experienced trucking accident attorney would investigate and seek to answer when pursuing a legal claim or lawsuit on behalf of any injured victims.
