A Passenger’s Options After an Accident
Suffering an injury as passenger is a confusing and scary situation to be in. Many people are unsure which insurance covers you: the other driver’s, your driver, or maybe even your insurance.
If the driver of the other vehicle was not at fault for the accident, it’s unlikely you’ll receive compensation through their insurance policy. Even if they were partially at fault, it could take months for the legal process to play out.
What’s more likely is you’ll be compensated through the insurance policy of the driver of your car. The simplest way is through personal injury protection (PIP) or Medical Payments (MedPay). These coverages apply to all passengers in the car, meaning they are “first-party” benefits.
No matter who is at fault for the accident, PIP and MedPay should cover your expenses.
If your driver does not have PIP or MedPay, things become a bit more difficult. You could file a claim through your driver’s bodily injury insurance. This may seem awkward and combative, but remember: the claim is not against your friend or family member, only against their insurance policy.
Finally, if you have your own insurance, your PIP or MedPay may apply to you in the accident. But these coverages have limits, and in serious wrecks, it may not cover all your bills.
