Seattle University School of Law Invites Davis To Speak

Davis Law Group founder Chris Davis has been invited to speak at Seattle University School of Law's annual Choices Career Exploration Conference which be held on April 11th. 

Davis will be speaker and panelist at the “Enhancing Your Legal Career through Writing” seminar.  The session is designed to help law students understand how to advance their careers through good writing.  Davis has been invited to discuss his book “The Ten Biggest Mistakes That Can Wreck Your Washington Accident Case.”

Chris Davis appointed to WSTLA Board of Governors

Christopher Davis has been appointed to The Washington State Trial Lawyers Association (WSTLA) Board of Govenors for the 8TH Congressional District.  The WSTLA Board of Governors sets directions for the association and meets every other month. Officers are elected at the WSTLA annual meeting for a one year term, all district and at-large representatives are elected for a two year term.

Key responsibilities will include:

  • Communicating with clients in a respectful and appreciative way

  • Drafting basic correspondence, memoranda, pleadings and discovery, and preparing evidence and scheduling witnesses for trial

  • Organizing and writing settlement demand letters
  • Maintaining, organizing and indexing all case files and other documentation for staff attorneys

Qualifications:

  • Minimum 2-3 years of experience as a Legal Assistant or Legal Secretary or Paralegal in a law office.  Personal Injury experience strongly preferred
  • Strong proficiency with MS Word/Office and the ability to type at least 60 wpm
  • Experience with Timeslips and Abacus software is a plus.
  • Ability to multitask and work in a fast-paced environment, and under deadlines
  • Outstanding communication and interpersonal skills to communicate with court personnel, other attorneys and their secretaries, clients, witnesses
  • Energetic and positive with ability to maintain strict confidentiality
  • High level of professionalism and the ability to provide the ultimate in customer service
  • Extremely hard-working, efficient and open to working overtime

PRESS RELEASE: Drunk driving auto accident case settles for $350,000.

For Immediate Release
January 12, 2008

SEATTLE, WA - Seattle Attorney Chris Davis of the personal injury law firm Davis Law Group, P.S., has announced that his office recently settled a drunk driving auto accident case that occurred in Redmond, Washington back in January 2005.  The drunk driver* has agreed to a settlement of $350,000 for personal injuries inflicted on Mr. Davis' client.*

The accident occurred when the drunk driver was returning home after consuming drinks at the Lucky 7 tavern located in Kirkland, Washington.  The drunk driver admitted to consuming at least 4 drinks but possibly 5 over a 2 hour period.  The drunk driver lost control of his vehicle and then crossed into the oncoming lane where he struck a vehicle traveling in the opposite direction.  Mr. Davis' client, a 25 year-old man, was driving this vehicle.  Witnesses reported that the drunk driver was traveling as fast as 50-60 mph in a 25 mph zone. 

The Redmond Police Department responded to the scene.  Police officers could immediately determine that the driver was impaired.  He was arrested at the scene.  Later the driver blew a 0.159 BAC (breath-alcohol content).  The legal limit is 0.08 BAC.

Mr. Davis' client complained of neck and back pain.  He also hit his head in the collision and lost consciousness for several seconds upon impact.  The victim had persistent low back pain which ultimately led to surgery.  A lumbar MRI showed three herniated discs in the victim's low back.  Mr. Davis' client incurred approximately $35,000 for medical treatment related to his low back.

The drunk driver's insurance company Progressive Insurance Company refused to tender the drunk driver's insurance policy limits of $250,000 to settle the case when asked by Mr. Davis early on in the case.

Rather than risk an "excess verdict" at trial (i.e., a verdict that exceeds the amount of insurance available), the drunk driver agreed to confess judgment against him in the amount of $350,000.  The drunk driver also agreed to assign his rights and remedies against his own insurance company to Mr. Davis' client.  

Mr. Davis has indicated he will begin proceedings to collect the entire $350,000 judgment amount against the drunk driver's insurance company.  The drunk driver's insurance company may have violated the law by failing to protect its own insured when it refused to settle the case for policy limits. 

Mr. Davis has suggested that Progressive Insurance Company may have violated the recently enacted Insurance Fair Conduct Act (formerly known as Referendum 67) by engaging in "unreasonable" conduct harmful to its own insured.  The Act allows treble damages at the discretion of the court as well as attorney fees.  The Insurance Fair Conduct Act was approved by Washington State votes last November.

INTERVIEW: Upfront with Robert Mak on King5

On December 2, 2007 King5 television’s Sunday news magazine, Upfront with Robert Mak, focused on homeowners who are still waiting to settle claims from last year’s windstorm, insurance companies that don’t promptly pay claims, and other unfair insurance claims handling practices.  The program also featured the Davis Law Group’s founder, attorney Chris Davis and his book “The Ten Biggest Mistakes That Can Wreck Your Washington Accident Case”.

 The producers chose to close the program by asking Chris to summarize his experience with insurance companies and offer advice to consumers who are facing the insurance claims process.

 TRANSCRIPT

MAK:  So what does this mean for consumers?  And can you take steps to avoid a dispute with your insurance company?  Seattle trial attorney Chris Davis has a new book “The Ten Biggest Mistakes That Can Wreck Your Washington Accident Case”.  What should you do if you are in an accident?  We are joined now by attorney Chris Davis.  Mr. Davis, give me one of the biggest mistakes that people make after an accident or a wind storm and they have to file an insurance claim?

DAVIS:  The biggest mistake that I see is probably the failure to preserve evidence or documenting the claim, the injury, or the harm that’s been done.  That might include taking photographs calling the police, obtaining witness statements…all the information in the beginning so you can prove the claim down the road.

MAK:  Now you start with the premise that consumers should not think of their insurance adjustor as having their best interest in mind.  And yet we just hear Mr. Newman say that insurance companies do settle claims quickly…that people are generally satisfied.

DAVIS:   I would say this, the insurance industry is in it to make a profit; adjustors are trained to save the company money by settling claims for less perhaps than they may be worth.  So right off the bat there is an adversarial relationship.  Yes, many claims are settled promptly, the question though is whether those claims or those settlements are actually fair.  I am simply advising people to at least consult with a lawyer or find out what your rights are in the beginning of the claim process because that is going to help individuals down the road.

MAK:  I think a lot of people are apprehensive about bringing in a lawyer right away.  I mean, isn’t that setting up an adversarial relationship just by me going out and hiring a lawyer for a claim?

DAVIS:  Well, people have to understand that the insurance industry right off the bat is doing what they need to do to minimize the claim and perhaps pay out less than what may be reasonable.  I am not urging people to hire an attorney immediately.  I am simply saying, you know, it may be in your best interest to just consult with a lawyer or at least do some research on your own to find out what your rights are, what the insurance company’s obligations are so that if you do decide to go it alone you’ll have as much information as possible to make the best decision.

MAK:  And very quickly, do you think that most people have the wherewithal to go it alone with an insurance company?

DAVIS:  If we are talking about the typical individual, absolutely not.  We are talking about insurance companies that have hundreds of millions perhaps billions of dollars…the leverage is usually almost always on the side of the insurance company.

PRESS RELEASE: W.A. Botting Company Sued for Wrongful Death of 41 year-old Mother of Four

Seattle, WA., August 24, 2007 - Christopher M. Davis of Davis Law Group, P.S., the attorney representing the family of Sandra K. Johnson, age 41, who died in a car accident on May 25, 2007, announces today that he has filed a wrongful death action against WA Botting Company of Woodinville. The suit was filed in King County Superior Court (case# 07-2-26904-5KNT) on behalf of Ms. Johnson?s estate and her four children. Ms. Johnson?s mother, Beverly Hein, 65, also joined the lawsuit.

Johnson was killed while stopped in her car waiting for traffic to clear on Auburn Way South. A W.A. Botting employee, John M. Starr, was driving a company vehicle on Auburn Way South. Starr drove his vehicle off the roadway and crashed into Johnson's vehicle at a high rate of speed. The lawsuit alleges that Ms. Johnson was stopped in her car and had no opportunity to avoid the collision. Johnson, a mother of four, died at the scene.

The Auburn Police Department investigated the accident. Starr reportedly told police that he had previously pulled a double-shift for Botting and then fell asleep at the wheel while driving home. The investigation has been turned over to the King County Prosecuting Attorney's Office for review of possible criminal charges.

Johnson worked as a caregiver for Catholic Community Services in Tacoma. She is survived by her children, Dustin (age 5), Zachary (age 6), Shyla (age 14) and Crystal Peterson (age 20).

"The whole family has been devastated by the loss. The children are distraught as you can imagine. They miss their mother terribly," said Mr. Davis. "What is also upsetting is that the children may have to be split up to live with different caretakers," says Davis.

The lawsuit claims unspecified damages for future lost income and services, as well as damages on behalf of the children for the loss of their mother. Any funds recovered on behalf of the children will be placed in trust and administered through a court-appointed guardian.

CHRIS DAVIS INTERVIEW: KIRO TV Coverage of Dog Mauling Attack

August 23, 2007

Seattle attorney Chris Davis was recently interviewed by KIRO TV concerning the recent dog mauling attack in Pierce County. Sue Ann Gorman was recently attacked by two pit bulls that broke into her home. The dogs were owned by neighbors. Gorman was viciously attacked after the dogs broke into her home through a sliding glass door while she was sleeping. Gorman believes the pit bulls were after her pet dogs. Gorman was severely injured and described the attack as dogs "ripping off her skin." She must now undergo wound care and possible plastic surgery in the future.

KIRO TV contacted Mr. Davis as a legal expert on dog bite cases. Davis was asked about what happens to most dog bite cases. "Most of these cases are settled out of court by the insurance companies," says Davis. "Only rarely is a dog owner ever criminally prosecuted for an attack committed by the owner's dog." Davis states, "Often times these cases, particularly those involving children as victims, can settle for amounts well into the six figures. The insurance companies usually do not like to see these cases go to trial."
