On May 6, 2009 at approximately 5:00 p.m., J.M. was a passenger in a Transpro van for the disabled was traveling eastbound on State Route 160. As the van went through the intersection at Long Lake Road SE, a driver A.Y., who was stopped on Long Lake Road SE, unexpectedly entered the intersection, striking the left rear of the van.
Washington State Patrol responded to the scene and upon investigation cited your insured for failure to yield the right-of-way. Upon impact, J.M.'s body was violently jolted and tossed around the inside of the vehicle hitting against the interior components. His head was thrown sideways and then snapped back in a whiplash like motion. Additionally, his body was slammed against the restrain of his seatbelt. J.M. sustained injuries to his neck, back, and associated body structures. A summary of his injuries and treatment are outlined below:
Cervical strain/sprain and subluxations with in tenderness, pain, muscle spasms, and limited range of motion. Whiplash injury with resultant ligamentous instability and acceleration of spinal disc disease. Diagnosis
