The following is a description of the accident and the injuries of a former Davis Law Group client. *Initials are used to protect the identities of the parties involved.
Davis Law Group Client Accident Report
In December 2007 SM was traveling westbound on N.E. Woodinville-Duvall Road going about her daily errands. She was unexpectedly struck head-on by SH, who lost control of her vehicle and crossed the center line, striking SM.Following the impact, SM was trapped in her vehicle until fire department personnel came to her rescue.King County Sheriff’s Office responded to the scene and upon investigation cited SH for “speed too fast for conditions”.
Washington law provides that the drivers on the road have the duty to exercise ordinary care and avoid causing a collision.See RCW 46.61.445 and Washington Pattern Jury Instruction (WPI) 70.01. As a direct result of SH’s negligence, SM sustained injuries to her leg, knee, ankle, and associated body structures.
A summary of her injuries and treatment are outlined below.
Ankle fracture (left) with resultant pain, discomfort, swelling, bruising, decreased range of motion and limited mobility
Foot injury and fracture (left) with resultant pain, discomfort, swelling, bruising, decreased range of motion and limited mobility
Leg fibula fracture (right) with resultant pain, discomfort, swelling, bruising, and limited mobility
Sleep disturbances/fatigue
SM is a 71 year old woman who enjoys spending time with her family and friends.Hobbies include yard work, walking her dogs, garage sales, shopping, traveling to visit family, reading, music, movies, and outdoor activities.
SM has experienced, and continues to experience, a significant loss of enjoyment of life.She was fairly healthy before the collision and since then has not as active as she was before.She must perform daily exercises at home just to manage/maintain her symptoms and avoid flare ups.Her return to recreational activities has been slow and guarded for fear of re-injury.
