MC is a 12-year-old girl who lives with her parents, in North Bend, Washington. In March 2001 MC was a front seat passenger in a vehicle driven by her mother, JC. They were traveling lawfully through the intersection of 436th Avenue and the Interstate 90 exit ramp #32 when their vehicle was slammed on the side by uninsured driver WJ. MC suffered personal injuries as a result of the collision.
MC’s mother’s uninsured motorist coverage via GEICO Direct should have provided for MC’s medical treatment after the accident. But GEICO claims adjustors disputed MC’s injuries and treatment needs. GEICO said that chiropractic care and massage treatment should be unnecessary for a 12-year-old girl.
