Most cases (98% or more) involving children do not involve a lawsuit. If a lawsuit is necessary, a guardian must be appointed by the court to bring the lawsuit on the child's behalf. Typically the guardian will be the child's parent. But any person who is of sound mind and good judgment can act as the guardian for the child for purposes of the lawsuit.
