A survival action is another type of death case.  It occurs when the injured or damaged person dies, but that person's claim against the at-fault party continues to survive.  The estate is allowed to bring the action on behalf of the decedent to recover all damages.  For example, if a person is injured in a car accident and then dies several months later, the person's estate is permitted to pursue a claim for the decedent's pain and suffering, medical expenses, funeral expenses, lost wages and other damages caused by the negligent party.
