Q: How do you start a wrongful death lawsuit?
A: A wrongful death case can only be brought by the Personal Representative of the deceased person's estate. Therefore, the first step is for the court to appoint the Personal Representative. A petition must be filed, along with a sworn statement from the prospective PR and/or the estate's attorney. Usually, a surviving family member or close relative of the deceased acts as PR of the estate. But sometimes a professional (like an attorney or guardian) may act as the PR.
