$415,000 Settlement for Young Boy Hit by Car While Exiting Bus

A 7 year old boy was hit by a car after exiting a transit bus.  The boy was with his mother but ran off the bus and into the street.  The defendant driver was following behind the bus, but did not stop.  Instead, the defendant crossed the double-yellow center line in an attempt to pass the bus.  The boy had just walked past the front of the bus when the defendant struck him at 20 mph.

The boy was diagnosed with head injuries.  He complained of headaches and short term memory loss.  He incurred past medical charges of approximately $24,312.

The defendant's insurance company (Encompass Insurance Company) blamed the bus driver for stopping at an unmarked bus stop.  The bus driver was later dismissed on summary judgment.  The defendant then appealed to the Court of Appeals.  The case settled while the appeal was pending.

Awarded: $415,000 settlement
