$400,000 for 7 year old Boy Hit by Ford Explorer

A 7 year old boy was crossing the street when he was hit by a Ford Explorer going 20-25 mph.  The boy was knocked unconscious for a few minutes.  He was airlifted to Mary Bridge Hospital in Tacoma, Washington.

While at the hospital, the boy received a negative CT Head scan.  He complained of headaches and short term memory loss.  He incurred past medical charges of more than $20,000.

The case was complicated because the boy had previously been diagnosed with ADHD.  His medicla records showed that he had many of the same symptoms associated with mild traumatic brain injury before the accident.  However, Mr. Davis obtained a neuropschological evaluation that did a very good job at separating the pre-accident and post-accident condition. 

The boy's mother said she noticed her son had some concentration problems and anxiety issues approximately 4 years after the accident.  However, the defense hired two experts who were prepared to testify that the boy made a full recovery and that any problems he had were due to his ADHD condition.
