On July 25, 2006 D.A.* was traveling on State Route 99, S.A.*, unexpectedly cut in front of his vehicle, leaving him no time to stop or swerve to avoid the collision. The impact caused his vehicle to flip completely over. Police responded to the accident and upon investigation cited S.A. for "unsafe lane change". Upon impact, D.A.’s body was violently jolted and tossed around the inside of the vehicle. His head was thrown about and then snapped backwards/forward in a whiplash like motion, bluntly striking against the seat/headrest and other components of the vehicle. Additionally, his body was slammed against the restrain of his seatbelt. Paramedics from Lynnwood Fire Department arrived on the scene to find the vehicle still turned upside down and his family outside of it awaiting medical attention. D.A. was examined for his head pain, neck pain, back pain, and left elbow pain. Due to the extent of his injuries, he was subsequently transported to a nearby hospital. As a direct result of S.A.’s negligence, D.A. sustained injuries to his head, neck, back, and associated body structures. He had over $20,000 in medical treatment and will require some $25,000 in future medical care. He lost more than $16,000 in wages due to lost work.
