Pedestrian accidents can be horrible and result in life-changing injuries. Simply stepping out into traffic and assuming that cars will stop is one of the surest ways to end up in an accident. The best way to remain safe is to stay out of harm's way. Pedestrians should stay in a place of safety (i.e., the curb, a traffic island, etc.) until it's safe to cross. By the same token, a pedestrian should use his best judgment and not walk into the path of a moving vehicle that is so close that it's impossible for the driver to avoid a collision. To do so means that the pedestrian is at least partially negligent for failing to exercise ordinary care to avoid a collision.
