Man Run Over By Ice Cream Truck on Bike, Now Fighting For Bicycle Safety

A 24-year-old man celebrated National Bike to Work Day in May when his worst nightmare became reality.

“It was the first time I ever used my bike to commute,” he said. “The morning leg of the trip went fine, and I was feeling good about it.”

He was riding around 7 p.m. when an ice cream truck ran into him. He suffered from broken ribs, one which punctured his lunch.

The young man was in the hospital for a week, incapacitated for more than a month and is now very hesitant to get back on a bicycle.

“When the truck hit me, I was thrown up on the hood and then rolled off and landed in front of its front left tire,” he said. “The tire then rolled over me and remained on my back before it eventually backed up off of me.”

The man was screaming from the pain in his back from the tires.

“The truck pulled out from a side street near Burke Station Road without seeing him. . . . We were first on the scene before the ambulance arrived, and it was terrible,” a witness said.

Since the accident, Brandan Markham is determined to bring more public awareness to bicycle safety.

“I have gotten involved with the Washington biking association, and I want to get out there and speak to the public to educate both drivers and cyclists about sharing the road safely,” he said. “No one should have to go through what I did.”

On the same national holiday, an 18-year-old was killed on his bike when an SUV hit him by driving into the bicycle path.

A worker at the police department who compiles bicycle accident statistics for the police department, said drivers and cyclists often are equally at fault when such accidents occur.

He said motorists should treat bicycles as vehicles, and behave accordingly. And cyclists should act as vehicles at all times, and obey all traffic rules and laws.

For Markham, bicycle safety education has become a new priority in his life after his traumatic experience.

Davis Law Group is proud of Mr. Markham for taking the initiative in hthe fight against bicycle safety. There are far too many bicycle accidents, many of which lead to death. We wish you the very best in your endeavors.
