Pedestrian Law In Washington State and Metro Seattle l Crosswalk Accident Lawyer

RCW 46.04.160 Crosswalk
Summary: "Crosswalk" means the portion of the roadway between the intersection area and a prolongation or connection of the farthest sidewalk line or in the event there are no sidewalks then between the intersection area and a line ten feet therefrom, except as modified by a marked crosswalk.

 

WAC 132E-16-040 - Right of Way
Summary: (1) Stopping for pedestrian. (2) Pedestrian sudden movements. (4) Overtaking vehicles stopped for pedestrian. (5) Yield right of way. (6) Curb ramps.

 

WAC 504-14-940 Pedestrians
Summary: When traffic control signals are not in place or not in operation at pedestrian crossings, a vehicle must yield the right of way, by slowing down or stopping, when the pedestrian in the crossing is upon the same half of the roadway as the vehicle, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.

Summary: Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right of way to all vehicles upon the roadway.

 

RCW 46.61.261 Sidewalks, crosswalks -- Pedestrians, bicycles.
Summary: The driver of a vehicle shall yield the right of way to any pedestrian or bicycle on a sidewalk. The rider of a bicycle shall yield the right of way to a pedestrian on a sidewalk or crosswalk.

 

SMC 11.40.160 Crossing intersection
Summary: No pedestrian shall cross a roadway intersection diagonally unless authorized by official traffic-control devices; and, when authorized to cross diagonally, pedestrians shall cross only in accordance with the official traffic-control devices pertaining to such crossing movements. (RCW 46.61.240(4))

SMC 11.40.180 Standard of care for drivers of motor vehicles - Seattle Municipal Code
Summary: The driver of a vehicle approaching a pedestrian who is carrying a cane predominantly white in color (with or without a red tip) or using a guide dog shall take all necessary precautions to avoid injury to such pedestrian.

 

SMC 11.40.220 Walking on sidewalk - Seattle Municipal Code
Summary: Where there are sidewalks provided, no pedestrian shall move along and upon an adjacent roadway. Where sidewalks are provided but wheelchair access is not available, disabled persons may move along and upon an adjacent roadway until they reach an access point in the sidewalk.

SMC 11.40.240 Walking in roadway - Seattle Municipal Code
Summary: Where sidewalks are not provided any pedestrian moving along and upon a street shall, when practicable, move only on the left side of the roadway or its shoulder facing traffic which may approach from the opposite direction and upon meeting an oncoming vehicle shall move clear of the roadway.

SMC 11.40.250 Playing in streets - Seattle Municipal Code
Summary: No person upon roller skates, or riding in or by means of any coaster, skateboard, toy vehicle or similar device, shall go upon the roadway of any arterial street or transit coach route, except while crossing such street at a crosswalk; or engage in any sport, amusement or exercise or play in the roadway of any street.
(Ord. 108200 Section 2(11.40.250), 1979.)

 

SMC 11.40.420 Pedestrian right-of-way - Seattle Municipal Code
Summary: The City Council may by ordinance designate streets upon which pedestrians will be granted right-of-way over vehicles using that street.

SMC 11.58.310 Regard for pedestrians - Seattle Municipal Code
Summary: Notwithstanding the provisions of Chapters 11.40 and 11.44, every operator of a vehicle shall exercise due care to avoid colliding with any pedestrian or person riding a bicycle upon any roadway and shall give warning by sounding the horn when necessary, and shall exercise all proper precautions upon observing any child or any obviously confused or incapacitated person upon a roadway. (RCW 46.61.245)

SMC 15.48.010 Snow and ice removal - Seattle Municipal Code
Summary: It is the responsibility of the owner or occupant of private property to remove snow and ice on the sidewalks abutting his or her property in a timely manner and, if practical, prevent its becoming or remaining in an icy, ridged, uneven or humped condition or in a condition which is potentially hazardous to users of the public sidewalks.
(Ord. 117569 Section 121, 1995; Ord. 90047 Section 39, 1961.

 

RCW 70.84.040 Precautions for drivers of motor vehicles approaching pedestrian who is using a white cane, dog guide, or service animal.
Summary: The driver of a vehicle approaching a totally or partially blind pedestrian who is carrying a cane predominantly white in color (with or without a red tip), a totally or partially blind or hearing impaired pedestrian using a dog guide, or an otherwise physically disabled person using a service animal shall take all necessary precautions to avoid injury to such pedestrian. Any driver who fails to take such precaution shall be liable in damages for any injury caused such pedestrian. It shall be unlawful for the operator of any vehicle to drive into or upon any crosswalk while there is on such crosswalk, such pedestrian, crossing or attempting to cross the roadway, if such pedestrian is using a white cane, using a dog guide, or using a service animal. The failure of any such pedestrian so to signal shall not deprive him of the right of way accorded him by other laws.

Pedestrian Hit In Poulsbo Crossing Accident l Washington Injury Lawyer

April 27, 2009

A woman was was struck by an SUV while crossing a road in Poulsbo.  Apparently a Mitsubishi Montero was traveling southbound on Clear Creek Road near Beth Lane.  The driver he saw the woman crossing the roadway, braked hard, but was unable to stop before hitting her.

The young
woman was treated at the scene and then transported to Harrison Medical Center in Silverdale. She was later airlifted to Harborview Medical Center.

Bicycle Laws In Bellevue, WA l Bellevue Bicycle Accident Lawyer

Now that warmer weather is approaching more and more people will begin to ride bicycles to work and for recreational purposes.  Please be mindful of local bicycle laws so you can travel safely. 

Riding on the Sidewalk
Bellevue City  Code 11.60.061 Riding a bicycle on the sidewalk is permitted in Bellevue however the bicyclist should exercise caution and should not ride faster than is reasonable and proper.

Right-of-way on side walk
Bellevue City Code 11.60.062 Bicyclists who are riding on a sidewalk should yield to pedestrians and also signal to pedestrians by voice or some other audible signal that he/she is going to overtake and pass the pedestrian.

Bicycle Helmets
Bellevue City Code 11.60.090 Bicycle helmets are required in Bellevue on public roads, bicycle paths, sidewalks, right-of-ways or any facility under the jurisdiction.

15-year-old Girl Killed Crossing I-5 l Bellevue Pedestrian Accident Attorney

Haley B. Salvador of Everett, died trying to run across I-5 Sunday night. The 15-year-old ran eastbound across busy southbound lanes of the freeway near the Everett Mall round reported the Washington State Patrol.

Man Killed Trying to Cross I-5 l Seattle Lawyer

Date:  March 18, 2009
Location:  I-5 near Fort Lewis, WA
Type:  Pedestrian/Car Accident
Outcome:  One dead

A 21-year-old man was killed just before 1 a.m. Wednesday morning when he was hit by a car as he tried to cross I-5 near the main gate at Fort Lewis.

He was crossing the northbound lanes of I-5 when he was hit by a Toyota Corolla. The driver of the car was not injured.

He died at the scene. The military is notifying the man’s family of his death. His name has not been released.

The Washington State Patrol was looking into whether drugs or alcohol played a role in the accident.

Teen Injured In Crosswalk Accident l Seattle Lawyer

Fourteen-year-old William Sienkiewicz was crossing the street with his friends when 1990 Chevy pickup struck him.

Apparently there were several kids attempting to cross the road northbound.  They looked westbound but didn't see eastbound traffic.  The youth was stabilized by Lewiston Fire EMTs in the ambulance and transported to St. Joseph Regional Medical Center and later transported to Harborview Medical Center.  .

Car Hits Pedestrian in Spokane l Washington State Accident Lawyer

Around 10:30 Wednesday night a pedestrian was hit by a car while crossing Highway 2 in Airway Heights. The driver of the car was eastbound on Highway 2 when the collision occurred.

The Washington State Patrol said the pedestrian, stepped out in front of the car and the driver did not have enough time to stop. Troopers believe the man was just trying to cross the street he wasn't wearing reflective material but had on dark colored clothing.

The pedestrian is at Deaconess Medical center with serious injuries.

Marysville Boy Hit by Truck as he Crosses Street - Seattle Accident Attorney

Pickup Truck Hits Pedestrians In Seattle l Accident Lawyer

About 9:20 pm at the intersection of Third Avenue and Lenora Street three pedestrians were in the crosswalk legally when they were hit by a pickup truck.  Apparently the three people hit by the truck were from Michigan, visiting the Seattle area on vacation.  One was treated at the scene for a bruised leg, the others were transported to Harborview Medical Center with serious injuries, one of which police said was possibly life-threatening.

The driver is reportedly a 26-year-old from Tacoma.  He was taken to the King County Jail for vehicular assult.

Everett Teen Injured In Bicycle Accident l Injury Law Firm

A 15-year-old bicyclist is being treated at a Harborview Mediccal Center after being hit by a car in a crosswalk in south Everett. .

Apparently the boy was in the crosswalk riding across the busy street and several cars stopped.  Then a Cadillac Escalade driven by an Everett man hit him. The teen was taken to Providence Regional Medical Center Everett, then transferred to Harborview Medical Center in Seattle.. 

The incident remains under investigation.

Bike Rider Killed in Seattle Crash - Seattle Lawyer

A 39-year-old bicyclist died after colliding with a car on Wednesday morning at 6400 24th Ave NW.

Seattle Police say the bicyclist and the van were traveling southbound on 24th Ave when the accident happened. It looked like the van was changing lanes and the bicyclist lost control, fell and got caught under the van.

The victim was taken to Harborview Medical Center, where he later died.

An investigation is ongoing.

Man hit by car while crossing street in wheelchair l Washington Pedestrian Accident Attorney

Outcome:  One dead                         

A 58-year-old man in a wheelchair died after being hit by a car while in an unmarked crosswalk on Highway 99 near Gibson Road.

Washington State Patrol Troopers determined the 26-year-old driver of the Kia Sedona was not at fault.

Trooper Leary said, "(The victim) didn't judge the distance between himself and the car. The driver never saw him."

Pedestrians should be very careful on unmarked crosswalks, Leary said. That includes wearing bright or reflective clothing when on the road at night.

A pedestrian was taken to Harborview Medical Center on Thursday evening after being hit by a car on Bainbridge Island.

The 20-year-old man was crossing Highway 305 when he stepped in front of a car waiting to turn onto Agatewood and was struck by the Lexus four-door.  The man was conscious at the scene and didn't appear to be seriously injured.

An investigation is being conducted to determine if any charges will be filed against the driver.

Renton Bicyclist Hit by Car l Seattle Accident Lawyer

 A bicyclist died around 6:30 a.m. Thursday after a Lincoln Towncar turned left in front of him.

The 56-year-old bicyclist was heading southeast on Renton Avenue at the time of the accident.  He suffered fatal injuries and died at the scene. The driver of the Towncar was not hurt.

Bicycle Riders Subject to Rules of the Road l Seattle Bicycle Accident Injury Attorney

Child Bicycle Accidents Are More Common Than You Think l Seattle Child Injury Specialist



Other than automobiles, bicycles are associated with more childhood injuries than any other consumer product. More than 70% of children ages 5 to 14 (27.7 million) ride bicycles. This age group rides 50% more than the average cyclist, accounting for 21% of all bicycle-related deaths and nearly 50% of all bicycle-related injuries.

More than 130 children die every year in bicycle accidents and approximately 270,000 are treated in emergency rooms for injuries (Source: Safe Kids USA, www.safekids.org). Nearly half of these children sustain a traumatic brain injury because of their failure to wear a helmet or because of wearing an unsafe or improperly fitted helmet.

Studies have shown that a properly fitted helmet can reduce the risk of bicycle-related brain injuries by as much as 88%. Properly fitted bike helmets can prevent an estimated 75% of fatal head injuries to children each year. Motor vehicles are involved in approximately 90% of the fatal bike crashes that happen each year. About 60% of child fatalities in bike-versus-auto crashes occur on residential streets.

Parents need to realize that a child who does not wear a helmet is 14 times more likely to suffer a fatal crash than one who does. Clearly, all children should wear properly fitted helmets while riding a bicycle. The chances of injury and/or death decrease dramatically when wearing a protective helmet.

For some reason, my office has seen an increase in accident and injury claims involving children. I can't explain the increase, but there are more children who have sustained a traumatic brain injury in many auto and bicycle accidents. Woman Dies In Auburn Pedestrian Collision l Washington Pedestrian Accident Attorney

A 70-year-old woman was struck and killed in Auburn during a pedestrian accident.  The accident happened near the 3100 block of Auburn Way South.  Apparently an off-duty paramedic and an emergency room nurse were nearby when the accident occurred.  The two worked together to perform CPR. Their efforts were unsuccessful.  Auburn police are investigating the accident

Student struck while crossing street

RENTON, Wash. -- A student at Hazen High School was struck by a car while crossing a street near the school Monday Afternoon. School district spokesman Randy Matheson said one car had stopped for the student, who was in a crosswalk, but a car in another lane struck the boy as he was crossing at the intersection of Duvall Avenue Northeast and Sunset Boulevard. School had just let out when the boy, who is a senior at Hazen, was hit about 3 p.m. Matheson said the student suffered head and back injuries, but police said the boy's injuries were not life-threatening.Renton police are investigating the collision.

Helmet Policy and Laws - Seattle, WA & King County, WA

Did you know?  The city of Seattle and King County require (according to a Public Health Seattle-King County Regulation) that helmets be worn by all bicyclists of all ages. Bicyclists can be fined $30 for not wearing a helmet, although the fee may be waived if the bicyclist shows proof of having purchased a helmet.

Daylight Saving Time Switch & Increased Number Of Pedestrian Collisions & Car Accidents

The staff at the Davis Law Group, P.S. would like to remind you to set your clocks back one hour this weekend.  Please use extreme caution as you adjust to the time change and earlier darkness.  When the clocks move back an hour at the end of daylight savings time, pedestrian collisions, crosswalk accidents, and personal injury cases involving motor vehicles are more likely to occur.
According to a CNN report, pedestrians walking at dusk are three times more likely to be struck by a car than before the clocks moved back
The highest risk for pedestrians occurs around 6pm during the month of November. This risk decreases each month until May, when the spring time change and longer days cause pedestrian accidents to drop dramatically. Reports show that it is not the actual dark that causes these pedestrian car accidents, it is the drivers' adjustments to the earlier darkness. 
Drivers: Be on the lookout for pedestrians as you drive at dusk and after dark.
Pedestrians: Take extra care to make sure that drivers can see you.

Car Jumps Curb And Hits Three Pedestrians l Renton Accident Lawyer

RENTON - A crash that launched a car onto a sidewalk near Renton caused the vehicle to hit several pedestrians who were near a crosswalk.  Apparently a driver ran a red light at the intersection of Parkside Avenue and Petrovitsky Road in what is known as the Fairwood area of King County.  As a result, two cars crashed. One ran into another car, the other hopped the sidewalk and hit into two young teen girls.  It appears that the driver suffered a broken leg but the pedestrians were okay.

Woodinville Jogger Involved In Hit-and-Run l Washington State Personal Injury Attorney

WOODINVILLE - A light burgundy Nissan Pathfinder hit a jogger on May 1 on Woodinville-Duvall Road near Woodinville.  The jogger, Karl Eells, was thrown about 25 feet into a ditch.  The Pathfinder fled.  The jogger was left with broken bones in his upper back and a painful knee and shoulder that may need surgery in the future. The Pathfinder has a disabled license plate and there may be damage to the hood area.  Anyone with information on the vehicle or its driver can call the sheriff's office at 206-296-3311 or 911.
