Does Anyone Have Immunity in Wrongful Death Cases?



This generally can apply to government agencies and employees. In some instances, certain persons or agencies may be immune from a wrongful death lawsuit, meaning they cannot be sued for wrongful death.

Again, this depends on the state’s law. In some situations, government agencies and employees might be protected from a wrongful death lawsuit, or even family members in certain situations.

Recent federal laws give immunity from wrongful death claims to defendants in railroad collisions and certain product liability cases including medical devices. It was in debate whether drug manufacturers would have immunity in wrongful death cases, but that did not pass U.S. Supreme Court in 2009.
