A female driver was stopped at a traffic light on a state highway when a delivery driver for a local Volkswagen dealership drove his van into her vehicle. She suffered injuries to her neck; lower back; and right shoulder, arm, and hand.
The woman underwent extensive medical treatment and numerous tests for three years, including multiple epidurals and spinal injections, physical therapy, and CT scans. Five years after the incident, she underwent spinal surgery to treat a herniated disk. Before the accident she had been a pharmacist earning about $100,000 per year but is now now permanently disabled and cannot work.
The woman her husband sued the dealership alleging that the driver failed to keep a proper lookout. The defendant argued that her injuries were from two previous auto accidents.
The parties settled for $1.1 million, paid by the defendant’s insurance company.
