On December 8, 2023, at approximately 11:34 PM, our client L.C. was near the intersection of SE Everett Mall Way and SR-526 (Boeing Freeway) in Everett, Washington, when he was struck by a vehicle. The driver had been traveling westbound on State Route 527 crossing onto State Route 526 and collided with L.C. at the intersection. The force of the impact threw L.C. into nearby bushes on the northwest side of the roadway.
Investigators found a severely injured pedestrian lying in the bushes at the northwest side of the intersection. Everett Fire Medics were in the process of loading the victim onto a backboard, and the officer noted a significant gash on his abdominal area. It was discovered that the driver of the vehicle which struck the man had fled the scene of the accident without identifying themselves.
Officers found and collected evidence at the scene, including numerous car parts, personal belongings, and a pair of shoes scattered around the scene, indicating a high-impact collision.
EPD Officers located a witness at a separate location who provided initial statements about the incident. Meanwhile, the driver of the vehicle which had previously fled returned to the scene shortly after the investigation began.
The driver of the at-fault vehicle claimed they were traveling westbound on State Route 527, transitioning onto SR 526 towards Mukilteo. The driver claimed to have attempted to swerve to avoid a collision, but that it was too late to avoid striking the pedestrian.
Upon inspecting the vehicle in question, the investigating officer observed substantial damage on the passenger side of the vehicle, specifically on the front bumper, fender, mirror, and windshield. The collision had also caused the passenger side turn signal light, side mirror, and windshield wiper to go missing.
Before the accident, L.C. was an active and independent man living in Everett, Washington. This tragic collision left our client with devastating, life-threatening injuries. He was rushed to the hospital where medical professionals diagnosed him with multiple traumatic injuries, including a fractured skull, a compound fracture of the right arm, multiple fractured ribs, a fractured pelvis, and fractures to his left leg and left foot.
L.C. remained in a coma for several weeks following the crash. He was ultimately diagnosed with a traumatic brain injury (TBI), and his physicians confirmed that he had suffered permanent and disabling injuries from which he would never fully recover. His medical expenses exceeded $310,000.
